When is a Wayleave Agreement Required?

A Wayleaves agreement is essential when a tenant, whether residential or commercial, wants to install an internet connection through common areas to their property. Similarly, Network Providers need a Wayleave to install their network in a Landlord’s building.

If the network’s path crosses land owned by another party, a Wayleave is required.

While most newly refurbished buildings or new developments feature pre-installed fiber optic cables, older buildings may lack this modern infrastructure.

In most cases, a Network Provider will need to install cabling and equipment through the common areas or on the exterior of the building.

To protect the landlord’s interests and ensure tenants can access broadband services, a written agreement is essential to outline the consents provided to the Network Provider. These agreements address crucial matters such as installation costs, equipment maintenance and removal, compliance with safety regulations, and repair of any damage caused.

Additionally, a Wayleave agreement ensures the network provider does not gain possession rights over the common areas due to their equipment installation. It is in the freeholder’s best interest to meticulously document the rights and obligations of all parties involved.”
